Fox has yet to work out a contract with its one-time hit series "House." But if NBC has any hopes of stealing the show away, it will have to think again.

"House" is produced by Universal Media Studios -- a sister company to NBC -- but it's that reason why "House" is either staying at Fox or heading elsewhere if a deal can't be worked out.

According to Variety, the agreement between Universal Media Studios and Fox to air "House" prevents it from moving it to any networks or cable channels owned by the Comcast conglomerate. And it makes sense. During "House's" higher ratings days, Universal Media could've simply demanded a license fee untenable by Fox, and moved the show to its own network, to reap the rewards directly.

Instead, Fox gets fair dealing, while it works out the numbers with Universal Media in deciding whether the show will stay or go.

"House" has not had a good year. It's just inside the top 30 of all programs, but is no longer the network's highest-rated scripted show (that honor now belongs to "Glee"). It's lost nearly 18 percent of its audience from last year, and there are rumblings that Robert Sean Leonard -- who plays House sidekick Wilson -- is not returning next year.

The trade publication reports that Universal is looking for a two-year renewal -- possibly gearing up for a big series finale -- while maintaining the license fee its charged in years with better ratings. Fox wants a reduction, and is only willing to commit to a single year.

Even if there is a renewal, there still has to be some negotiating not only with creator and showrunner David Shore, but also almost the entire cast with the exception of star Hugh Laurie and co-star Olivia Wilde, who returned to the series this past week.

Fox will likely either negotiate a one-year deal close to the license fee it paid this season, or could give in to a two-year deal, only if Universal Media cuts that fee down considerably over those two years.

Either way, it's Universal Media that benefits from redistribution in the form of iTunes, Hulu and DVD. The more seasons that get produced, the more Universal Media stands to benefit from later sales.

"As you all know, there is no deal in place, but negotiations are ongoing," Shore recently told reporters, according to TV Guide. "Fox wants to have a Season 8, and NBC Universal wants them to have a Season 8. I fully expect there to be a Season 8, and we are proceeding on that basis."

So what happens if Universal Media Services (UMS) and Fox were not able to come to terms by midnight last night regarding the status of Fox’s hit series House, M.D.? Variety reported that as of Thursday night, both sides were far apart on terms for a new contract that would bring House back to Fox for an eighth season. It appears that no deal had been reached, by the deadline’s passage late Friday night.

It's been reported UMS has been seeking the same terms it’s had in the current contract, negotiated before the series’ fifth season. FOX argues, according to Variety, that due to a decline in ratings, the network wants a reduction in its what it pays to air the medical series starring Hugh Laurie. If no deal had been reached by the end of Friday’s negotiation session, Universal believes it would be free to air the show on one of its own networks; Fox disputes that assertion, saying that the contract it has with Universal doesn’t allow it. Universal’s networks include USA Network, Bravo on cable, and of course its flagship peacock, NBC.

In the meantime, the network only has commitments for an eighth season from star Hugh Laurie and Olivia Wilde, who plays Remy Hadley. Both actors have options in their existing contracts that would obligate them for next season. Other series regulars, including Robert Sean Leonard (Wilson), Lisa Edelstein (Cuddy) do not have contracts beyond the current season, which ends in May. Leonard is currently bound for Broadway, which is by all accounts his first love.

If House comes back for an eighth season, deals will still need to be worked out with most of the supporting actors as well as David Shore, whose contract with UMS expires the end of this season. In a conference call last week with television journalists, Shore noted that both FOX and Universal both want an agreement, and he is moving forward with plans as if it will happen.
According to Deadline Hollywood, the Friday night deadline was set by the parties; it is non-binding, and they can continue negotiating until a deal is struck. The real deadline comes with next month’s “Upfonts," held to each May to showcase the fall lineup for advertisers. It is also when the networks announce their fall lineups. The FOX “upfront” is scheduled for May 16, as is NBC’s.

If the parties cannot come to an agreement, one of several things may happen: the show moves to an NBC network, where it’s already heavily syndicated on both USA Network and Bravo, or the season seven finale will be the series finale. As of Sunday evening as I write this, there has been no public word on the state of negotiations.

Fox's exclusive negotiating window to renew the Universal Media Studios drama skein expired late Friday but the sides quietly agreed to extend it for at least a few more days (Daily Variety, April 15). Sources close to the situation predict that the deal will eventually get done, despite the prospect of NBCU relocating "House" to another network, possibly even NBC. Insiders note the only deadline that really matters is May 16, the date of Fox's upfront presentation in Gotham.

The sides are wrangling over the terms of an eighth season pickup for the Hugh Laurie starrer. UMS is seeking the same deal that it has had since the show's fifth season -- in which Fox covers the production costs plus a premium. Fox is looking to trim that fee because the show, while still potent, is not the ratings powerhouse it has been in past seasons.

Reps for Fox and UMS declined comment.
